Acceptance of terms

These Terms of Service govern your access to and use of the DentalCareOS website and platform. By accessing the website or using the platform, you agree to these terms. If you use the platform on behalf of a dental practice, you represent that you are authorized to accept these terms for that practice.

Description of service

DentalCareOS is a multi-location dental practice management platform with optional AI-assisted workflows that operate under human review. Features, availability, and configuration are described in the applicable customer agreement and order form.

Accounts and eligibility

Access to the platform requires an account provisioned by an authorized administrator at a customer practice. You are responsible for keeping your credentials confidential and for activity under your account. The service is intended for business use by dental practices in the United States.

Acceptable use

You agree not to misuse the service: no unauthorized access, no interference with the service or other customers, no uploading of unlawful content, and no use of the platform except as permitted by your practice's policies, applicable law, and these terms.

Customer data and PHI ownership

As between DentalCareOS and the customer, the customer owns its practice and patient data, including PHI. DentalCareOS processes that data to provide the service and as permitted by the Business Associate Agreement. We claim no ownership of customer data.

Fees and payment

Fees are set in the customer agreement or order form. We do not publish pricing on this website; pricing is provided per agreement based on the practice's size and needs. Payment terms, taxes, and renewals are governed by that agreement.

Intellectual property

DentalCareOS, including its software, design, and brand, is owned by DentalCareOS and protected by intellectual property laws. These terms grant no rights to our intellectual property except the limited right to use the service under the customer agreement.

Warranties and disclaimers

The website is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, to the extent permitted by law. Warranties for the platform, if any, are stated in the customer agreement and control over this section. This draft is not a warranty.

Limitation of liability

To the extent permitted by law, DentalCareOS is not liable for indirect, incidental, or consequential damages arising from use of the website. Liability relating to the platform is governed by the limits in the customer agreement.

Term and termination

These website terms apply while you use the website. Platform access begins and ends as set in the customer agreement. We may suspend or terminate website access for violation of these terms.

Governing law

These terms are governed by the laws of the state in which DentalCareOS is organized, without regard to conflict-of-law rules. The customer agreement may specify a different governing law for the platform, which controls for platform use. (Draft: confirm the governing-law state with counsel.)

Changes to terms

We may update these terms and will change the "Last updated" date. Continued use of the website after an update means you accept the revised terms.
